9. Consultations and Engagement

9.1 Initial Consultations

We offer initial consultations to prospective clients. During a consultation:

  • We will discuss your legal matter
  • We will evaluate whether we can assist you
  • We will explain our services and fee structure
  • You can ask questions about your case

A consultation does not create an attorney-client relationship. You are free to seek representation from other attorneys, and we are under no obligation to accept your case.

9.2 Case Evaluation

We will conduct a thorough evaluation of your case before agreeing to representation. We may decline representation if:

  • We have a conflict of interest
  • The matter is outside our area of practice
  • We determine we cannot provide effective representation
  • Other circumstances prevent us from taking your case

9.3 Engagement Agreement

If we agree to represent you, we will provide a written engagement agreement that includes:

  • Scope of representation
  • Fee structure and costs
  • Your responsibilities as a client
  • Our responsibilities as your attorney
  • Other terms of representation

10. Fees and Payment Terms

10.1 Fee Structures

We may charge fees on various bases, including:

  • Contingency Fees: A percentage of any recovery obtained
  • Hourly Fees: Charges based on time spent on your matter
  • Flat Fees: A set fee for specific services
  • Hybrid Arrangements: Combination of fee structures

The specific fee arrangement will be outlined in your engagement agreement.

10.2 Costs and Expenses

In addition to legal fees, you may be responsible for costs and expenses such as:

  • Court filing fees
  • Expert witness fees
  • Medical records fees
  • Deposition costs
  • Investigation expenses
  • Travel expenses

Cost responsibilities will be specified in your engagement agreement.

10.3 Contingency Fee Cases

For contingency fee cases:

  • You typically pay no attorney fees unless we recover money for you
  • Our fee is a percentage of the recovery
  • You may still be responsible for costs and expenses
  • The percentage may increase if the case goes to trial
  • All terms will be clearly stated in the engagement agreement

11. Confidentiality and Attorney-Client Privilege

Once an attorney-client relationship is established:

  • All communications between you and the firm are confidential
  • Information you share is protected by attorney-client privilege
  • We will not disclose your information without your consent, except as required by law or ethical rules
  • You should keep all communications with us confidential to preserve privilege

Before an attorney-client relationship is formed: Communications may not be privileged or confidential. Do not share sensitive information until we have entered into an engagement agreement.

12. Disclaimers and Warranties

12.1 No Guarantee of Results

IMPORTANT: We cannot and do not guarantee specific results in any legal matter. Every case is unique and outcomes depend on many factors including:

  • The specific facts of your case
  • Applicable law
  • The judge or jury
  • Actions of opposing parties
  • Available evidence

Past results do not guarantee future outcomes.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation applies to the Site only and does not limit our liability for legal malpractice in the provision of legal services to clients with whom we have an attorney-client relationship.

  • Your violation of any law or the rights of a third party

15. Termination of Representation

Either you or we may terminate the attorney-client relationship, subject to:

  • Ethical obligations and rules of professional conduct

Upon termination, you remain responsible for:

  • Payment of fees and costs incurred before termination
